Terms & Conditions

Effective Date: October 27, 2026

Terms Version: 2026-10-27-v4

These Terms & Conditions (“Terms”) apply to purchases, deliveries, services, Project Quote requests and use of wildrhodesranch.com provided by Wild Rhodes Ranch, LLC.

PLEASE READ THESE TERMS CAREFULLY. CERTAIN PROVISIONS ADDRESS DELIVERY ACCESS, PROPERTY-DAMAGE RISK, CUSTOMER RESPONSIBILITIES, ASSUMPTION OF RISK, LIMITATIONS OF LIABILITY AND INDEMNIFICATION.

1. Agreement to Terms and Electronic Acceptance

By placing an order through the website and affirmatively checking the required acceptance boxes, the customer agrees to these Terms and acknowledges that these Terms are part of the transaction.

Orders may also be prepared by Wild Rhodes Ranch staff at the customer’s request, for example over the phone. In that case the customer receives a secure review link and must personally review the order and accept these Terms before the order is submitted.

The customer also represents that the customer is at least 18 years old and has authority to place the order and authorize the requested delivery.

Electronic acceptance, electronic records and electronic transactions may be used to document the agreement.

2. Definitions

“Customer” means the person or entity placing the order and, where applicable, the property owner or person authorizing delivery.

“Delivery Property” means the property or project location to which materials are requested to be delivered.

“Wild Rhodes Ranch Parties” means Wild Rhodes Ranch, LLC and its members, owners, managers, officers, employees, drivers, agents, representatives, contractors and subcontractors.

The Wild Rhodes Ranch Parties are intended beneficiaries of the protections, acknowledgments, releases, limitations and indemnification provisions contained in these Terms to the extent permitted by law.

3. Materials, Quantities and Natural Variation

Bulk materials are sold in whole cubic-yard increments unless otherwise stated.

Loam, compost, gravel and other natural or bulk materials may naturally vary in color, moisture content, texture, particle size, composition and appearance.

Photographs, samples and descriptions are intended to provide a general representation and are not a guarantee that every delivered load will have an identical appearance.

The customer is responsible for determining whether a material is suitable for the customer’s intended project unless Wild Rhodes Ranch expressly agrees in writing to a specific specification.

4. Coverage Estimator and Quantity Selection

Any Coverage Estimator or quantity guidance provided by Wild Rhodes Ranch is a planning aid only.

Actual material requirements may vary because of measurements, grading, compaction, settlement, site conditions, waste, project design and other factors.

The customer is responsible for selecting the quantity ordered.

Wild Rhodes Ranch does not guarantee that an estimated or ordered quantity will be sufficient to complete a particular project.

5. Pricing, Minimum Orders, Taxes and Payment

Current material pricing, applicable minimum material charges, delivery charges and sales tax are shown or calculated during the ordering process.

Wild Rhodes Ranch may correct an obvious website, clerical or calculation error before fulfillment. If a correction materially changes the amount owed, Wild Rhodes Ranch will contact the customer before proceeding.

Electronic payments are processed through Stripe and are subject to successful payment authorization.

For credit card orders, the customer is not charged when the order is submitted. After Wild Rhodes Ranch approves the order and delivery date, a secure Stripe payment link is sent to the customer by email and/or text message. Card payment is due by 5:00 PM the day before the scheduled delivery.

Wild Rhodes Ranch does not receive or store complete credit or debit card numbers.

Wild Rhodes Ranch may permit payment by cash or check when arranged with the customer.

When payment by cash or check is arranged, payment is due upon delivery and must be received by the driver before material is unloaded.

6. Requested Delivery Dates

Requested delivery dates are requests only and are not guaranteed.

Wild Rhodes Ranch will contact the customer to confirm the delivery date and approximate delivery timing before dispatch.

Delivery may be affected by weather, equipment availability, road conditions, material availability, site conditions, governmental restrictions and other circumstances.

7. Customer Authority to Authorize Delivery

The customer represents and warrants that the customer either:

(a) owns or lawfully controls the Delivery Property; or

(b) has obtained permission from the property owner or other authorized person to order the materials, authorize entry onto the Delivery Property and designate the requested access route and unloading location.

The customer is responsible for obtaining any permission necessary for Wild Rhodes Ranch to enter and deliver to the Delivery Property.

8. Delivery & Site Access Terms

This section is specifically incorporated into every material delivery order.

Loaded material trucks and related equipment are large and heavy. Entry onto private property and unloading bulk material can create risks to paved and unpaved surfaces, landscaping and structures.

The customer is responsible for selecting and identifying a reasonably safe and suitable access route and requested unloading location.

Delivery Schedule and Confirmation: Deliveries are made Monday through Saturday, generally between 9 AM and 1 PM. Your delivery must be confirmed by 5:00 PM the day before your delivery date. If we do not have your confirmation by then, your delivery will not go out, and our team will try to reach you to reschedule.

Before delivery, the customer must disclose known or reasonably discoverable conditions that may affect safe access or unloading, including where applicable:

  • septic systems, septic tanks and leach fields;
  • wells;
  • underground tanks;
  • irrigation systems;
  • underground utilities;
  • drainage systems and culverts;
  • invisible pet fencing;
  • recently installed or thin pavement;
  • pavers;
  • curbing;
  • sidewalks;
  • retaining walls;
  • soft shoulders or unstable ground;
  • steep grades;
  • narrow driveways or gates;
  • low branches;
  • overhead wires or utility lines;
  • low-clearance structures;
  • landscaping features;
  • buried structures;
  • weight-restricted surfaces; and
  • other hidden, underground, overhead or structural hazards.

The customer must keep children, pets, vehicles, contractors and other persons or obstructions reasonably clear of the truck’s operating and unloading area.

9. Driver Safety Discretion

The driver has final discretion regarding whether a requested access route or unloading location can reasonably be used safely.

Wild Rhodes Ranch is not required to drive onto a surface, enter an area or unload at a location the driver reasonably determines may be unsafe, inaccessible or unsuitable for the vehicle, equipment, persons or property.

If the requested location is unsuitable, the driver and customer may agree upon a safer accessible unloading location.

If delivery cannot reasonably be completed because of inaccurate or incomplete information, inaccessible conditions, undisclosed hazards or an unsuitable customer-selected location, delivery may be postponed or rescheduled.

Any additional redelivery charge, if applicable, will be communicated before a new delivery is made.

10. Acknowledgment and Assumption of Site-Related Risk

The customer acknowledges that the weight, dimensions, movement and operation of loaded delivery vehicles may create a risk of cracking, rutting, sinking, scuffing or otherwise damaging driveways, pavement, pavers, curbing, sidewalks, lawns, landscaped areas, drainage structures, septic systems, underground systems and other surfaces or property when site conditions are insufficient for the vehicle or when hidden hazards exist.

To the fullest extent permitted by applicable law, the customer assumes responsibility for property damage to the extent caused by:

  • a customer-selected access route or unloading location;
  • inadequate load-bearing capacity of a surface or subsurface;
  • concealed, underground, overhead or undisclosed site conditions;
  • inaccurate information provided by the customer;
  • the customer’s failure to disclose a known or reasonably discoverable hazard;
  • instructions or directions given by the customer or persons acting on the customer’s behalf; or
  • the customer’s breach of these Delivery & Site Access Terms.

Nothing in these Terms is intended to waive or limit liability that applicable law does not permit to be waived or limited.

11. Release Regarding Customer-Controlled Site Conditions

To the fullest extent permitted by law, the customer releases the Wild Rhodes Ranch Parties from claims for property damage to the extent arising from customer-controlled or customer-selected access conditions, unsuitable load-bearing surfaces, hidden or undisclosed hazards, inaccurate customer representations or customer-directed access or unloading locations.

This release does not apply to the extent a claim is finally determined to have been caused by conduct for which liability cannot lawfully be waived or limited.

12. Indemnification for Customer-Controlled Risks and Third-Party Claims

To the fullest extent permitted by law, the customer agrees to defend, indemnify and hold harmless the Wild Rhodes Ranch Parties from third-party claims, losses, liabilities and reasonable costs to the extent arising from:

  • the customer’s lack of authority to authorize entry or delivery;
  • inaccurate or misleading information supplied by the customer;
  • the customer’s breach of these Terms;
  • unsafe or undisclosed conditions at the Delivery Property;
  • customer-selected access routes or unloading locations;
  • instructions provided by the customer or persons acting on the customer’s behalf; or
  • acts or omissions of the customer, property owner, contractors, occupants, guests or animals at the Delivery Property.

This indemnification does NOT require the customer to indemnify a Wild Rhodes Ranch Party for that Wild Rhodes Ranch Party’s own negligence, gross negligence, recklessness or intentional misconduct, and it shall be interpreted and limited as necessary to comply with applicable Rhode Island law, including any law applicable to construction-related agreements.

13. Vehicle Recovery Caused by Site Conditions

If a Wild Rhodes Ranch vehicle becomes stuck or requires towing or recovery because of a concealed, undisclosed or materially misrepresented condition at the Delivery Property after access was directed or approved by the customer, the customer may be responsible for reasonable recovery costs to the extent permitted by law.

This provision does not apply to costs caused by mechanical failure or conduct for which Wild Rhodes Ranch is legally responsible.

14. Completion of Delivery and Bulk Material Returns

Once the correct bulk material has been unloaded at the agreed delivery location, the material becomes the customer’s responsibility.

Because bulk material cannot ordinarily be recollected, separated and returned after unloading, delivered bulk material generally cannot be returned after it has been dumped.

Nothing in this section eliminates a customer’s rights with respect to delivery of the wrong material, a material nonconformity for which Wild Rhodes Ranch is legally responsible, or rights that cannot lawfully be waived.

Customers should promptly contact Wild Rhodes Ranch regarding any claimed delivery error or material issue so the matter can be reviewed before the material is moved, mixed, spread or altered when reasonably possible.

15. Limitation of Certain Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WILD RHODES RANCH PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL ECONOMIC DAMAGES ARISING FROM AN ORDER OR DELIVERY, INCLUDING LOST PROFITS, LOSS OF USE, PROJECT DELAY, BUSINESS INTERRUPTION OR THIRD-PARTY CONTRACTOR CHARGES, EXCEPT TO THE EXTENT SUCH DAMAGES CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

Nothing in these Terms excludes or limits liability for personal injury, fraud, gross negligence, reckless or intentional misconduct, or any other liability that applicable law does not permit to be excluded or limited.

16. Delays and Events Outside Reasonable Control

Wild Rhodes Ranch is not responsible for delay or inability to perform caused by circumstances reasonably outside its control, including severe weather, unsafe road or site conditions, governmental restrictions, road closures, material shortages, utility events, accidents, equipment failure despite reasonable maintenance, labor disruptions, natural disasters or similar events.

Wild Rhodes Ranch will make reasonable efforts to communicate material delivery changes when practicable.

17. Project Quotes

A Project Quote submission is a request for review and is not, by itself, a binding price quotation, contract, guarantee of availability or guarantee of service.

Wild Rhodes Ranch will review the submitted information and contact the customer regarding materials, availability, delivery, site considerations, scheduling and pricing.

18. Snow Services

Wild Rhodes Ranch provides snow relocation and haul-away services.

Wild Rhodes Ranch does not provide snow plowing.

Snow services are subject to equipment availability, site access, weather conditions, safety considerations and individual project requirements.

20. Privacy

Use of personal information is governed by the Wild Rhodes Ranch Privacy Policy available at /privacy.

Acceptance of these Terms does not constitute optional consent to marketing or promotional communications.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles, except to the extent another jurisdiction’s nonwaivable law applies.

To the extent legally permitted, disputes arising from an order, delivery or these Terms shall be brought in a state or federal court having jurisdiction in Rhode Island.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to comply with applicable law.

The remaining provisions shall continue in effect to the fullest extent permitted by law.

23. No Waiver

Failure by Wild Rhodes Ranch to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision in the future.

24. Entire Order Agreement

These Terms, together with the customer’s order details, applicable price and delivery information presented during checkout, and any written modifications agreed to by Wild Rhodes Ranch, constitute the agreement governing that order.

If Wild Rhodes Ranch expressly agrees in writing to project-specific terms that conflict with these Terms, the project-specific written terms control to the extent of that conflict.

25. Changes to These Terms

Wild Rhodes Ranch may update these Terms for future transactions.

The version accepted by the customer at the time an order is submitted will govern that order unless the parties subsequently agree otherwise.
